Paper Abstract:      The increase of unsolicited commercial e-mail (UCE) had become a significant problem for e-mail users, and more recently, also a problem for mobile phone users, due to the SMS spam. UCE causes a loss of both user’s time and money, and can be considered an attack to user’s privacy. The countermeasures to the problem of UCE can be provided by the legal and technical worlds. In this paper we analyze the UCE direct marketing providers ways to offer their products. However, its advertising cannot suppose an attack to the customer’s privacy. For this reason we discuss the European legislation on the subject, and compare the European approach with the solutions adopted in the US.
