Paper Abstract:      The technological landscape has changed at a much faster pace than constitutional law and the case law on cyberspace and facsimile communications are meager on both state and federal court levels. The development of e-mail, chat rooms, list serves, newsgroups and instant messaging constitute even greater challenges to governments because these communications may be used for illicit or illegitimate purposes. The growing use of computers prompted Congress to amend the Copyright Act in 1998 and pass the Digital Millennium Copyright Act to protect materials published on the World Wide Web. The keys to this new legal world may ultimately lie in the hands of the U.S. Supreme Court, which must strike the balance between promoting technology and protecting society.
