Paper Abstract:      New technology, new laws? It is not always necessary, but sometimes some changes can be useful to adapt new technologies to “old” rules. New problems appear in the m-commerce: small screens, small processors, limited memory… There is a need to consider if the rules for electronic commerce and consumer protection can be applied to mobile commerce. But there are different mobile devices and not all of them have the same characteristics (mobile phone, blackberry, handheld…). This paper presents a reflection on the technical and juridical problems of establishing contracts with small screens devices. Recently, Spanish Law 56/2007, December 28, about Information Society establishes that the duty to inform the user, in the case of small screen devices, will be fulfilled in a web page. This solution raises many problems: the design of the contractual process, the moment of the conclusion of the contract, the acknowledgement,… We present a set of open questions related with the legal framework of m-commerce.
