The international transfer relies on the Data Protection Directive. It requires special precautions when personal data is transferred to countries outside the European Economic Area (EEA, which includes all EU countries and in addition, non-EU countries Iceland, Liechtenstein and Norway) that do not provide EU-standard data protection. This article describes the different available exceptions or derogations with a special focus on transfer from the EU to the United States. Data transfer to the US used to rely on a Safe Harbor Agreement adopted by the European Commission in 2000. In October 2015, the European Court of Justice ruled this decision was invalid which deprived the transfer of its legal basis. On Feb. 2, 2016 the European Commission announced it has reached a political agreement with the US. This article aims at highlighting the terms and conditions of such transfers in this new context. |
