Paper Abstract:
|
The collection of evidence from computers, other digital devices or networks will involve making copies of that evidence
that can be manipulated and analyzed so that the original evidence can be preserved without change. This act of making a
copy could involve a copyright infringement. Some exemption is offered if copies are to be used for judicial proceedings.
However some aspects of forensic investigation may fall outside this exemption. Convictions or the outcome of
proceeding may be challenged at a later date resulting in costly and complex appeals. The legality of work commissioned
privately is vague and we are opening a debate on the need for review. |
